1. Acceptance of Terms

By accessing or using GrowingUpVideo ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

GrowingUpVideo is an AI-powered video generation platform that creates transition videos from user-uploaded images. The Service uses third-party AI services including:

• Anthropic Claude for image analysis and ordering
• PixVerse for video generation, with fal.ai as a fallback provider

3. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We use Clerk for authentication. Your use is also subject to Clerk's terms of service.

4. Payments

4.1 Pricing

We offer various pricing tiers as described on our pricing page. Prices are subject to change with 30 days notice.

4.2 Billing

• Payments are processed through our payment provider
• Purchases are one-time credit purchases; there is no recurring subscription

4.3 Free Tier

We may offer a free tier with limitations. Abuse of free tier (creating multiple accounts, etc.) may result in termination.

4.4 Refund Policy

We offer a 30-day money-back guarantee. If you're not satisfied with your video, email us at info@growingupvideo.com within 30 days of your purchase with your order email and purchase date, and we'll refund you, no questions asked. Refunds are issued to the original payment method and typically processed within 4-10 business days.

Abuse prevention: this guarantee is meant for genuine one-off dissatisfaction, not a way to get repeated free videos. We may decline a refund if your account has a history of refunded purchases or otherwise shows a pattern we reasonably consider abusive.

5. Acceptable Use

5.1 You agree NOT to:

• Upload images or audio you do not have rights to use
• Upload illegal, harmful, or offensive content (see Content Policy)
• Attempt to reverse engineer or copy the Service
• Use the Service for any illegal purpose
• Circumvent usage limits or quotas
• Share account credentials
• Automate access to the Service without our written permission
• Upload images containing malware or viruses

5.2 Usage Limits

• Maximum 8 images per job
• Maximum file size: 10MB per image
• We reserve the right to enforce rate limits

6. Intellectual Property

6.1 Your Content

You retain ownership of images and audio you upload, and of the videos we generate for you, subject to (a) any third-party rights in the images or audio you upload, and (b) your compliance with our Acceptable Use section. You grant us a limited, non-exclusive license to process your uploads solely to provide the Service, including sending them to the third-party providers listed in this section and our Privacy Policy.

6.2 Our Content

GrowingUpVideo and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other laws.

6.3 AI-Generated Content

Videos generated by our Service may be subject to third-party AI provider terms. You are responsible for ensuring your use of generated content complies with applicable laws.

7. Third-Party Services

We use third-party services to provide the Service:

• AWS: Infrastructure and storage
• PixVerse: Video generation
• fal.ai: Video generation (fallback)
• Anthropic: Image analysis
• Clerk: Authentication

Your use of these services through GrowingUpVideo is subject to their respective terms.

8. Termination

8.1 By You

You may delete your account at any time through the account settings.

8.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Violation of our Content Policy
• Fraudulent or illegal activity
• Non-payment
• Extended inactivity

8.3 Effect of Termination

Upon termination:

• Your access to the Service ends immediately
• We will delete your data per our Privacy Policy (30 days for stored content)
• No refund for unused subscription time

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Generated videos will meet your specific requirements
• Results will be accurate or suitable for any particular purpose
• The Service is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for third-party services (fal.ai, Claude, etc.)
• We are not liable for content uploaded by users

11. Indemnification

You agree to indemnify and hold harmless GrowingUpVideo from any claims arising from:

• Your use of the Service
• Content you upload
• Your violation of these Terms
• Your violation of any third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Israel.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration in Tel Aviv, Israel. You waive any right to participate in class actions.

13. Copyright Complaints

If you think something on GrowingUpVideo infringes your copyright or another right you hold — a photo, a video, or audio a user has added to a video — email info@growingupvideo.com with a notice that includes:

• what work or right you're claiming is infringed;
• where to find the content on our Service (a link or a clear description);
• how to reach you;
• your good-faith statement that the use hasn't been authorized by you, your agent, or the law; and
• your statement, made under penalty of perjury, that you're the rights holder or authorized to act for them, and that the notice is accurate.

We'll look into notices that meet these requirements and may take down or restrict the content in question. Accounts with repeated infringement may be suspended or closed.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
